Agreement and scope

These Terms of Use (“Terms”) constitute an agreement between you and the operator of Fundamental.org (“Fundamental.org,” “we,” “us,” or “our”).

These Terms govern your access to and use of fundamental.org, its church directory, meeting listings, newsletters, resources, accounts, subscriptions, digital products, and related products and services provided through Fundamental.org (collectively, the “Services”).

By accessing or using our Services, you agree to these Terms. If you do not agree with these Terms, please do not use the Services.

Our Services

Fundamental.org provides a church directory and ministry resources designed primarily for Independent Fundamental Baptist churches, pastors, missionaries, ministries, and people seeking churches that identify with the King James Bible.

The Services may include church and ministry listings, meeting and event submissions, articles, resource links, newsletters, and optional paid listings or sponsorships where offered.

Privacy

Your use of our Services is also subject to our Privacy Policy, which explains how we collect, use, store, and protect personal information.

Privacy Policy:

Fundamental.org Privacy Policy

Electronic Communications

When you create an account, submit a form, send us an email, request assistance, or otherwise communicate with us electronically, we may send electronic responses and notices reasonably related to that interaction. Merely visiting our website or accepting these Terms does not constitute consent to marketing text messages or enrollment in an email newsletter.

We may communicate with you through email, website notifications, account notifications, SMS where separately authorized, or other electronic means.

You agree that electronic agreements, notices, disclosures, and other communications satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.

Email communications and unsubscribing

We may send newsletters, prayer and ministry updates, meeting announcements, and promotional emails when you subscribe, request them, or otherwise authorize them as required by applicable law. The signup form identifies the sender and purpose. An email subscription does not authorize marketing text messages.

You can unsubscribe from optional email communications at any time using the unsubscribe link included in the message or by emailing in**@*********al.org. We honor requests promptly and, for commercial email, within 10 business days or sooner when required by applicable law. There is no fee to unsubscribe, and you do not need to create or log in to an account.

Unsubscribing from promotional emails does not prevent essential, non-promotional messages concerning an existing account, a transaction you requested, security, billing, or legal notices. We will not use these messages to bypass your marketing preferences.

Email and SMS preferences are managed separately unless you request that all optional communications stop. Please identify the email address or mobile number affected so we can process your request. Unsubscribing does not itself delete your account, remove a public church listing, or cancel a paid subscription. Contact us to request those separate actions.

Our commercial emails identify the sender accurately, use non-deceptive subject lines, identify advertising where required, and include a valid physical postal address and a working unsubscribe method.

Church Registration and Email Updates

By registering a church or creating a church listing on Fundamental.org, you agree to receive emails from Fundamental.org at the email address provided. These communications may include registration confirmations, listing updates, requests to verify church information, directory news, ministry resources, event announcements, and information about services relevant to churches. Where applicable law requires separate consent for optional or promotional emails, we will obtain that consent before sending them.

You may unsubscribe from optional or promotional emails at any time using the unsubscribe link in the email or by contacting in**@*********al.org. Unsubscribing will not remove your church listing. We may still send essential, non-promotional communications about your account, listing administration, security, or requested transactions.

Church registration does not constitute consent to receive marketing text messages. SMS consent is obtained separately.

The following terms apply if you choose to participate in a Fundamental.org text messaging program.

SMS Program Description

SMS Messaging Terms and Conditions

If offered, the Fundamental.org SMS messaging program provides text messages to individuals who specifically choose to receive them.

By separately opting in to the applicable SMS program, you agree to receive the types of messages described at signup, which may include church listing notices, requested follow-up, ministry updates, prayer updates, event reminders, support messages, account notices, and promotional messages where separately authorized. Messages may be sent using automated technology. An opt-in to one program or purpose does not authorize unrelated marketing.

Messages may include:

• Product and service updates

• Demo and appointment reminders

• Requested follow-up communications

• Customer service and support messages

• Account and subscription information

• Ministry and event announcements

• New product or feature announcements

• Special offers and promotional messages

SMS Consent

Marketing SMS consent is separate from email marketing consent.

We obtain your affirmative consent through an appropriate opt-in method before sending SMS messages, except responses or other messages expressly permitted by applicable law. Marketing messages require separate express written consent where required. Providing a number in a directory listing, importing a contact, accepting these Terms, or subscribing to email alone does not constitute SMS consent.

Consent to receive marketing SMS messages is not a condition of purchasing any product or service.

By opting in, you represent that you are the subscriber or authorized user of the mobile number provided and that you have authority to consent to receive text messages at that number.

Message Frequency

Message frequency varies.

Message and Data Rates

Message and data rates may apply depending upon your wireless carrier and service plan.

Opting Out

You may opt out of SMS communications at any time by replying STOP to a message from us.

After you send STOP, you may receive a final confirmation message indicating that you have been unsubscribed.

After your opt-out has been processed, no further messages will be sent from that SMS program unless you separately opt in again, except a permitted, non-promotional confirmation of your request. We honor other reasonable requests to revoke consent, including requests sent to in**@*********al.org, as required by applicable law. Requests are processed promptly within applicable legal deadlines.

Help

For assistance with SMS communications, reply HELP to a message or contact us at:

in**@*********al.org

Wireless Carriers

Wireless carriers are not responsible for delayed or undelivered messages.

Message delivery is subject to your carrier, wireless network availability, device capabilities, and other factors outside our control.

SMS Privacy

We respect the privacy of your mobile information.

Mobile phone numbers, SMS opt-in information, and consent information will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

SMS opt-in data and consent will not be shared with third parties for marketing purposes.

We may share information with vendors and service providers, including messaging and telecommunications providers, when reasonably necessary to operate, support, and deliver our SMS messaging program.

For additional information about how Fundamental.org collects, uses, and protects personal information, please review our Privacy Policy:

Fundamental.org Privacy Policy

Changes to the SMS program

We may modify, suspend, or discontinue our SMS messaging program at any time.

We may also update these SMS Terms periodically. Changes will become effective when the revised Terms are posted, unless otherwise required by applicable law.

Messaging permissions and contact information

If you submit, upload, or import another person’s contact information, you must have the rights and permission required for the intended communication. Publicly available contact information, purchased lists, or a church directory entry alone do not establish consent to receive text messages. You may not enroll another person in a messaging program without the required authorization.

We may maintain records of consent, the signup source, the date and scope of permission, and opt-out requests to operate the program and honor communication preferences. We may retain a limited suppression record to avoid contacting someone who has unsubscribed, subject to our Privacy Policy and applicable law.

Keep your contact details current. Before giving up or changing a mobile number, opt out and notify us so messages are not sent to a reassigned number. Consent applies only to the sender, purpose, and messaging program disclosed when it was obtained.

Messaging vendors may process contact details and message content only as necessary to provide the applicable service under our instructions and applicable privacy terms. Using a delivery provider does not authorize that provider to market independently to our contacts.

Account Security

If you create or use an account through our Services, you are responsible for maintaining the confidentiality of your login credentials and for restricting unauthorized access to your account.

You are responsible for activity occurring through your account to the extent permitted by applicable law.

You may not sell, assign, transfer, or provide unauthorized access to your account.

You agree to notify Fundamental.org promptly if you become aware of unauthorized access to or use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, threaten the security or operation of our Services, or are used unlawfully.

Subscriptions and Cancellation

If Fundamental.org offers paid subscriptions, recurring sponsorships, enhanced listings, or other recurring services, the following provisions apply.

Subscription prices, billing periods, features, and applicable terms will be disclosed at the time of purchase.

Unless otherwise stated, subscriptions automatically renew according to the billing period selected until canceled.

You may cancel a subscription according to the cancellation options available through your account or by contacting us.

Cancellation prevents future renewal charges but does not necessarily provide a refund for amounts already paid unless otherwise stated in the applicable offer, refund policy, or required by law.

Questions regarding subscriptions or cancellation may be directed to:

in**@*********al.org

Products, Returns, and Refunds

Refund and return eligibility may vary depending upon whether the purchase involves software, subscription services, digital products, professional services, or physical equipment.

Unless a separate written refund policy, proposal, contract, warranty, or product description provides otherwise, completed digital products and services are generally non-refundable after delivery or performance.

If we sell physical equipment, equipment that arrives damaged or contains a manufacturer defect should be reported to Fundamental.org within 10 days of receipt. Purchases made from an independently operated bookstore or other third-party seller are subject to that seller’s return and refund terms.

Manufacturer warranties may apply to certain equipment and may be administered by the applicable manufacturer.

Nothing in this section limits any rights that cannot legally be waived under applicable law.

Third-Party Websites and Services

Our Services may contain links to websites, applications, platforms, products, or services operated by third parties.

Fundamental.org does not control and is not responsible for the content, privacy practices, availability, security, policies, or operation of third-party services.

The presence of a third-party link does not necessarily constitute an endorsement by Fundamental.org.

Certain functionality provided through our Services may depend upon third-party service providers. Information may be shared with those providers when reasonably necessary to provide requested functionality, subject to our Privacy Policy and applicable law.

Third-Party Integrations

Certain Services may allow you to connect with third-party accounts, services, applications, APIs, or platforms.

By enabling an integration, you authorize the exchange of information reasonably necessary to provide the integration.

Your use of a third-party service remains subject to the terms and privacy policies of that third party.

You are responsible for reviewing those terms before enabling an integration.

Acceptable Use

You agree not to use our Services:

• For any unlawful or fraudulent purpose

• To violate another person’s intellectual property, privacy, or other legal rights

• To distribute malware, malicious code, or harmful software

• To interfere with or disrupt our systems or networks

• To attempt unauthorized access to accounts, databases, servers, or systems

• To impersonate another person or organization

• To send spam or unauthorized unsolicited communications

• To harvest contact information without authorization

• To circumvent security measures

• To interfere with another person’s use of the Services

• In any manner prohibited by applicable law

We may suspend or terminate access when we reasonably believe the Services are being misused.

Intellectual Property

The Services and their original content, software, designs, interfaces, branding, graphics, logos, databases, documentation, and other materials are owned by or licensed to Fundamental.org and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use our Services for their intended purposes.

Except where expressly authorized by us in writing or permitted by law, you may not:

• Copy or reproduce protected portions of our Services

• Sell or redistribute our software or proprietary content

• Reverse engineer or attempt to extract source code from proprietary software

• Remove copyright, trademark, or proprietary notices

• Create unauthorized derivative products based upon our proprietary software

• Use our trademarks in a manner suggesting an unauthorized affiliation or endorsement

Nothing contained in these Terms transfers ownership of Fundamental.org intellectual property to you.

User and Missionary Content

Certain Services may allow churches, ministries, missionaries, users, or organizations to submit church listings, meeting details, photographs, prayer requests, articles, videos, documents, biographies, ministry updates, links, contact information, or other content.

You retain ownership of content you own.

By submitting content to our Services, you grant Fundamental.org a non-exclusive license to host, store, process, reproduce, display, format, and distribute that content as reasonably necessary to provide and operate the Services.

You represent that you have the necessary rights or authorization to submit content you provide to us.

We may remove content that violates these Terms, applicable law, third-party rights, or the intended purposes of our Services.

Church directory and meeting listings

Submit information only for a church, ministry, or event that you are authorized to represent, and provide accurate, current information. You are responsible for correcting changes in leadership, addresses, service times, contact details, doctrine descriptions, or event schedules.

Listings and submissions may be reviewed, edited for formatting, declined, corrected, or removed when inaccurate, unauthorized, unlawful, or inconsistent with the directory’s stated purpose. Submission or payment does not guarantee permanent inclusion.

A listing is informational and does not constitute certification, a background check, or a guarantee of a church’s doctrine, leadership, conduct, safety, or services. Each church and ministry operates independently. Confirm details directly before visiting, attending an event, donating, or making arrangements.

Do not submit confidential prayer requests, private medical details, sensitive missionary locations, or personal information about others without authorization. Information submitted for public listings may be publicly visible and indexed by search engines.

You may not scrape or harvest directory contacts for unsolicited outreach. Featured placement or sponsorship, where offered, does not guarantee referrals, attendance, donations, or other results.

Availability of Services

We strive to maintain reliable Services but do not guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable because of maintenance, upgrades, internet disruptions, third-party service interruptions, security events, technical failures, or circumstances outside our reasonable control.

Features may be modified, replaced, improved, or discontinued from time to time.

International Users

Our Services are operated from the United States.

If you access our Services from another country or jurisdiction, you are responsible for compliance with applicable local laws.

You may not use our Services in any country or manner prohibited by applicable United States laws, sanctions, export restrictions, or other applicable regulations.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

FUNDAMENTAL.ORG DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH WARRANTIES CANNOT LEGALLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNDAMENTAL.ORG AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR USE.

SOME JURISDICTIONS DO NOT PERMIT CERTAIN WARRANTY DISCLAIMERS OR LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, THESE PROVISIONS WILL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Fundamental.org and its officers, employees, contractors, and agents from claims, damages, liabilities, costs, and reasonable legal expenses arising from:

• Your unlawful use of the Services

• Content you submit through the Services

• Your material violation of these Terms

• Your infringement of another person’s rights

• Your violation of applicable laws or regulations

Fundamental.org reserves the right to assume control of the defense of a matter subject to indemnification, in which case you agree to reasonably cooperate with that defense.

Termination

We may suspend or terminate access to our Services when reasonably necessary because of a violation of these Terms, unlawful activity, fraud, abuse, security concerns, nonpayment, or conduct that threatens Fundamental.org, our customers, our users, or our Services.

You may discontinue use of our Services at any time, subject to any applicable subscription, contract, or payment obligations.

Governing Law and Jurisdiction

These Terms and disputes relating to them will be governed by the laws of the State of South Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.

To the extent a dispute may properly be brought in court, the parties consent to the jurisdiction of the appropriate state or federal courts located in South Carolina, unless applicable law requires a different jurisdiction or venue.

Severability

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

Entire Agreement

These Terms, together with our Privacy Policy and any additional written agreement, order, proposal, subscription terms, or service-specific terms applicable to a particular product or service, constitute the agreement between you and Fundamental.org regarding your use of the Services.

If a separately executed written agreement conflicts with these general Terms, the separately executed agreement will control with respect to the subject matter it covers.

Changes to These Terms

Fundamental.org may update these Terms periodically.

When changes are made, the updated Terms will be posted on our website with a revised “Last Updated” date.

Your continued use of the Services after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
